SCHEDULING ORDER
Pursuant to Rule 1-016 NMRA, the Court enters the following Scheduling Order. The
Parties are ordered to comply with the following deadlines:
1. Plaintiff shall disclose, by name and available contact information, and file with the
Court a list of all potential fact witnesses who could be called by either party to testify at trial by
April 19, 2024.
2. Defendant shall disclose, by name and available contact information, and file with the
Court a list of all potential fact witnesses who could be called by either party to testify at trial by May
3, 2024.
3. Plaintiff shall disclose expert witnesses and provide a written report for each expert
witness, by May 31, 2024. Written expert reports shall include all matters discoverable under Rule
1-026(B)(6) NMRA and shall be provided to the opposing party for each expert identified. A list of
such experts shall be filed with the Court on or before that date, but no reports shall be filed.

4. Defendant shall disclose expert witnesses and provide a written report for each expert
witness, by July 19, 2024. Written reports shall include all matters discoverable under Rule 1-
026(B)(6) NMRA and shall be provided to the opposing party for each expert identified. A list of
such experts shall be filed with the Court on or before that date, but no reports shall be filed.
5. Discovery shall be completed by August 30, 2024. Parties shall seek discovery
sufficiently before this date so that persons responding to discovery reasonably may comply with
discovery requests prior to the deadline. Any discovery motions shall be filed on or before the close
of discovery.
6. Challenges to or motions to exclude expert reports or anticipated testimony under
Rules 11-702 or 11-703 NMRA, including Daubert/Alberico motions, shall be filed by September
6, 2024.
7. All dispositive and pretrial motions, other than motions in limine, shall be filed by
September 6, 2024.
8. The deadline to conduct mediation is September 20, 2024. Before the deadline, the
Parties shall do one of the following:
a. Retain an independent mediator of their choice and conduct a mediation;
b. Request that a District Judge from the District act as a settlement facilitator pursuant to
Rule LR5-206 NMRA. Any such a request must be supported by a showing why the parties
cannot retain an independent mediator. There will be limited availability of Judges to serve as
facilitators given existing caseloads and demands on Judges’ time; or
c. Obtain an Order from the Court to be exempt from the requirement of settlement facilitation.
9. A Status Conference is set September 3, 2024 at 9:00 a.m. by Google Meet.

10. The deadlines stated in may not be varied absent an Order of the Court based on a
showing of good cause. Sanctions may be imposed for failure to comply with this Scheduling Order,
including exclusion of witness, testimony, or exhibits.
